人在国外，怎么委托中国律师代理诉讼案件？

外国当事人签章，包括外国自然人当事人本人签章、外国企业或组织的代表人签章两种类型。根据签署地点的不同情况，外国当事人签章的授权委托书的证明手续不同，具体如下：

（一）境内签署

1.由人民法院法官见证。外国自然人当事人本人、外国企业或组织的代表人，可出示其身份证明文件（护照等）及入境证明（以电子方式展示的入境记录等），在人民法院法官的见证下签署授权委托书、起诉状等文件。经人民法院法官见证后，无需办理公证、认证或其他证明手续。

2.经我国公证机关公证。外国自然人当事人本人、外国企业或组织的代表人，在我国境内签署的授权委托书、起诉状等文件，可通过我国公证机关办理公证手续。经我国公证机关公证后，无需办理认证或其他证明手续。

（二）域外签署

外国自然人当事人本人、外国企业或组织的代表人，在我国领域外签署授权委托书的，根据上述人员所在国的不同情况，需办理公证、认证或其他证明手续（如“附加证明书”等）：

（1）外国企业或组织所在国属于《取消外国公文书认证要求的公约》缔约国且我国未对其作出保留的，外国企业或组织的身份证明类文件需经所在国公证机关公证并加贴“附加证明书”。

（2）外国企业或组织所在国不属于《取消外国公文书认证要求的公约》缔约国，或属于《取消外国公文书认证要求的公约》缔约国但我国对其作出保留的，外国企业或组织的身份证明类文件需经所在国公证机关公证并经我国使领馆认证。该所在国与我国没有建立外交关系的，可以经该国公证机关公证，经与我国有外交关系的第三国驻该国使领馆认证，再转由我国驻该第三国使领馆认证。

另外要注意，所有国外的材料在交到法院之前，如是非中文版本的，必须要在中国境内找到高院指定的翻译公司翻译成中文，并加盖翻译公司的翻译章，否则中国法院是不做审查采纳的。

2.SigningoutsideChina-Depingonthecountrywheretheoverseasnaturalpersonpartyortherepresentativeoftheoverseasenterpriseororganizationislocated,theymayneedtogothroughnotarization,certification,orothercertificationprocedures(suchas"Apostille",etc.):-IfthecountrywheretheforeignenterpriseororganizationislocatedisasignatorytotheConventionAbolishingtheRequirementofLegalisationforForeignPublicDocumentsandChinahasnotmadereservationsagainstit,identitydocumentsoftheforeignenterpriseororganizationneedtobenotarizedbythenotaryofficeinthatcountryandaffixedwithan"Apostille".
